| Do I need an Attorney? I worked for the Social Security Administration for over six years and I was asked this question thousands of times by disability claimants. My answer is always the same: “If I were in your shoes, I would have an Attorney representing me.” There are fundamental reasons why representation is critical to your case. In general, an Attorney is able to get more accurate information faster about your case - where it is and how long it will take to process. An Attorney is better able to ask the right questions of your doctors’ information that is more in line with Social Security disability law. An Attorney can also ensure that you will get all the money that you are entitled to by asking that your previous applications be reopened and payments be made back to your earliest application or earlier, if you qualify. Your Attorney should also tell you what to expect at a hearing, what you should and should not do, and how to properly respond to questions asked by the Judge. Your Attorney should know whether or not you should be tested by a vocational expert and/or psychologist, and what tests are needed. Social Security has rigid and unforgiving time restrictions on filing initial disability claims and appeals. Adequate representation will assure that these time frames are not missed. Usually, it is best to stay away from representatives who ask for a fee whether they win or lose. Look for those who specialize in Social Security disability cases. Some attorneys and representatives have taken on SSA disability cases without knowing the law and botch them up miserably -at the claimants expense. |
There is no substitute for inside experience. I worked for the Social Security Administration for over six years. I have processed literally thousands of disability claims for the Social Security Administration. I have seen first hand what mistakes claimants and representatives can make in filing for disability. I cannot guarantee you that you will win your case but I believe that if I cannot get you approved, nobody can. In addition to my experience with the Social Security Administration, I am also a licensed attorney. I will let Social Security know that I am representing you and, if necessary, ask Social Security to give you a hearing. I will complete the necessary paperwork in the way that Social Security needs them completed. I will ask Social Security for a copy of your file. After getting a copy of your file, I will review it to see what more evidence I need to get from the doctors and hospitals. I will get this evidence. I will send this evidence to Social Security. I will, of course, be at your hearing and ask you questions. If any witnesses other than you are needed at your Social Security hearing, I will tell you in advance. I will keep track of your case to make sure that Social Security does not lose it or forget to give you a hearing or send you a decision. If I win, I will keep on Social Security to make them pay you your benefits as soon as possible. If you lose, I will talk to you about your options. The fee for Social Security representatives is set by law. In the majority of cases the fee is set at 25% of the claimants back paid benefits not to exceed $5300. There will be no fee unless you are approved for disability benefits. Remember, a delay in contacting my office could result in lost benefits for you and your family.
